As a user of the Vcast website, it may be necessary for you to provide to ("Vcast (Asia) Ltd.” or "Vcast") with your personal information (“information”) at the time of registration and at various times when using the website.

You hereby agree that the information you provide to Vcast (“us/we”) is provided voluntarily, and is accurate, true, current and complete. If this is not the case, or if we have reasonable grounds to suspect as such, we have the right to cancel your registration and/or refuse any and all current or future use of the websites and its services to you. If the information you provide to us is incomplete or incorrect, we may not be able to provide or continue to provide the products, services etc. offered in the website to you or may not permit you or may discontinue your access to the website.

While this allows us to offer you the best service possible, we understand the critical importance of personal privacy and want you to understand how we handle your personal information.

Security

We take reasonable precautions to keep your personal information secure from unauthorized access, such as encrypted transmission between your computer and our servers and internal corporate policies to limit access to systems that store your personal information. We continue to store your personal information for so long as it is necessary to provide you our service and periodically destroy old personal information in accordance with our company policies, including when it is no longer essential to us. In most cases, we will keep one archival copy of your information to allow us to comply with laws or respond to legal processes.

Sharing of your Information with Others

You understand that any and all information you provide to us will be collected and may be used for the purposes of:

• keeping you updated, respond to, confirm or fulfill your requests, and notifying you of service issues and unusual account actions;
• enforcing our Terms of Service or the Vcast End User License Agreement;
• protecting personal safety;
• complying with laws, industrial practices or respond to legal processes;
• allowing for a change of ownership of Vcast and associated transfer of all personal information to the new owner of Vcast, in which case your information still remains protected under this Privacy Policy;
• allowing third party suppliers, vendors, contractors and other parties to provide products and services to us or otherwise act on our behalf (this may include, without limitation, us authorizing such third parties to email our users regarding updates, surveys and other inquiries regarding their experience with the Vcast Software and service);
• allowing for advertising and other audits, and surveys to, among other things, validate the size and composition of the viewing audience, and understand its experience with the Vcast Software and service. This may require, among other things, disclosing your viewing history and/or disclosing records showing which advertisements were viewed by which IP addresses;
• providing the merchandise and analysing, verifying and/or checking your credit, payment and/or status in relation to the provision of merchandise;
• analysing and comparing your information with that of others for product/services customization and/or marketing (direct or otherwise) purposes;
• maintaining contact lists for correspondence;
• processing your orders or transactions;
• operating internal controls, including determining amounts owed to or by uses, payment or collection of such amounts from users and from any persons providing security for users’ obligations and enforcing any charge or other security granted by or for users;
• forwarding publicity and/or marketing materials or other information to users ;
• assisting any person who is acquiring or participating in any contractual arrangements between us and the user to evaluate the transaction for such acquisition or participation;
• assisting bona fida third party in its investigation into any offence and/or tortious act, where such bona fide third party has reasonable grounds for believing that such offence/tortious act is being or has been committed by you in the course of your use of the website.

We will also share statistical and demographic information about our users and their use of the Vcast Software with suppliers of advertisements and programming. This would not include anything that could be used to identify you or to discover individual information about you.

Widgets and Cookie

We, and third parties, may from time to time make small software applications – that we call "widgets" – available for your use on or through the Vcast Software. These widgets may separately access, and allow a third party to view, your identifiable information, such as your name, your Vcast name, your computer's IP Address or other information such as what you are watching during any given session. Additionally, these widgets may ask you to provide additional information directly to third parties. Third party products or services provided through widgets are not owned or controlled by Vcast. You are encouraged to read the terms and other policies published by such third parties on their websites or otherwise.

We may use cookie files or other methods to store and track information about you when you visit the website and this is done without you being aware that it is occurring. You acknowledge and agree that you are solely responsible for the form, content and accuracy of any material or information placed by you on the website. You are aware, agree and authorise that all information supplied by you will be retained by and stored in one or more databases of Vcast website and will be provided to, disclosed to, accessed by and transferred to:

1. any person or company or division within us;
2. any person or company under a duty of confidentiality to us;
3. our employees;
4. any contractors, agents, other persons or companies engaged by us for or in relation to any of the purposes listed above or any of our third party service providers;
5. any person or company to whom we transfer or propose to transfer its interests and/or obligations in respect of that user or any product or service provided to that user;
6. any nominee, trustee, professional who is involved with the provision of our services to that user;
7. any person by whom we are required by applicable legal, governmental or regulatory requirements to make disclosure;
8. any other person reasonably requiring the same in order for us to carry out the purposes set out herein. You agree that we may release your information when such release is reasonably necessary to:

i. comply with applicable law;
ii. enforce or apply the terms of any of user agreements;
iii. protect the rights, property or interest of us or users;
iv. comply with our privacy policy statement; and/or
v. any bona fide third party who has reasonable grounds for believing that an offence and/or tortious act is being or has been committed by you in the course of your use of the website and has made a reasonably request for our release of your information.

Using Your Personal Information in Other Countries

Your country's privacy laws may require your consent before your personal information can be exported to countries with weaker privacy laws. Using the website implies your consent to this practice so that we can enhance our service quality by operating in multiple countries. No matter where your information is processed, this privacy policy will remain in effect.

Access to Your Information

You are aware of your right under the Personal Data (Privacy) Ordinance, including the right:

1. to check whether we hold any of your information;
2. to have access to your information we hold;
3. to request correction of your information. You agree to pay to us the reasonable charges we request in complying with the request;
4. to ascertain our policies and practices from time to time in relation to the information and the types of information we hold;
5. to disallow our access or use of your information;

You can access and update most of your personal information through the Vcast Software. If you wish to review and/or correct any other personal information not yet available through the client software or if you do not receive email or promotional direct mailings and you choose to opt out, please contact Vcast at enquiry@vcast.net.

We cannot guarantee that the transmission of data is all secure. While we shall take all practicable steps to ensure that any information collected by us via the website is safe and secured from third party interference, other website that have links on our website may collect personal data about you.

Security Assurance

You shall be careful that your details including your User ID and/or Password are not compromised by ensuring that you do not knowingly or accidentally share, provide or facilitate unauthorised use of it. Do not share your User ID and/or password or allow access or use of it by the others. If, in the unlikely event, unauthorised transactions have been conducted through your account, we take no responsibility for your loss for the transaction.

Consent and Changes to this Privacy Policy

Your use of this site implies your consent to the collection of the information described in this policy. We have the right to revise the policy from time to time. You are advised to check about it regularly.
